    North Star SHRM will be hosting a virtual seminar titled: Worker Misclassification: State and Federal Perspectives on Wednesday, July 12, 2023, from 8 a.m. to 9:30 a.m. All North Star SHRM members are invited to attend via Zoom. There is no cost to attend.

    A meeting link will be sent to all North Star SHRM members a few days before the event.

    This class, which features speakers from the Minnesota Department of Labor and Industry and the U.S. Department of Labor – Wage & Hour Division, will provide both state and federal guidelines on the various ways that misclassification of employees can occur.

    The session will include a review of the factors each agency uses to determine if a worker is an employee or an independent contractor. The class will also include guidance on how to avoid misclassifying non-exempt employees who must be paid overtime, from overtime exempt workers. As a bonus, the session will also touch on trade misclassification that occurs in government contract work.

    Learning objectives:

    • Attendees will have a clearer understanding of the important factors to use in making determinations on which workers are employees, and which workers may be independent contractors.
    • Attendees will gain a clearer understanding of what factors the state and federal agencies rely on in determining which employees may be exempt from overtime under common state and federal exemptions.
    • Attendees will gain a clearer understanding of the type of trade misclassification that can occur on government contract work.

    Corey Walton has been with the U.S. Department of Labor/Wage-Hour Division since 1997. He spent 15 years as an investigator investigating hundreds of cases under several laws including the Fair Labor Standards Act, Davis-Bacon and the Family Medical Leave Act. Over the past 11 years, Corey has served as the Community Outreach & Resource Planning Specialist (CORPS) in Wage and Hour’s Minneapolis District Office. In that capacity, Corey spends most of his time organizing and conducting USDOL educational and training events throughout the states of Wisconsin and Minnesota.

    Dave Skovholt is the Outreach Coordinator in the Labor Standards Unit of the Minnesota Department of Labor and Industry (DLI), where he has worked since 2018. Dave’s outreach is focused on Minnesota’s Labor Standards laws. He travels throughout the state, meeting with business groups and community organizations. Before working at DLI, Dave was a labor union business agent, overseeing and negotiating collective bargaining agreements in Minnesota and throughout the Midwest.
