Minnesota recently became the 23rd state to legalize medical marijuana. Although the new law could improve opportunities for treatment of those suffering from certain conditions, it may create issues for employers and employees in "drug-free" workplaces. This is due, in part, to the fact that marijuana is still an illegal controlled substance under federal law.
Further, unlike medical marijuana laws in other states, Minnesota’s law gives additional protections to employees for the use of marijuana under certain circumstances. This law also interplays with Minnesota’s existing laws regarding the use of lawful consumable products and Minnesota’s Drug and Alcohol Testing in the Workplace Act.
While the legal implications of this law have not yet been tested in the courts, employers should become aware of how this law can impact the workplace. Learning objectives are:

- Learn how the medical marijuana act interplays with Minnesota’s Drug and Alcohol Testing in the Workplace Act and other laws
- Learn how the medical marijuana act interplays with the reasonable accommodations process.
